Privacy Policy

Gotaru Inc. (hereinafter, the "Company") establishes the following privacy policy (hereinafter, the "Policy") regarding the handling of privacy information in the service provided over the internet (hereinafter, the "Service").

Article 1 (Privacy Information)

  • Among privacy information, "personal information" refers to "personal information" as defined in the Act on the Protection of Personal Information, meaning information about a living individual that can identify the specific individual by name, date of birth, address, telephone number, contact details, or other descriptions, etc. contained in such information.
  • Among privacy information, "history information and characteristic information" refers to information other than the "personal information" defined above, and includes the services used or products purchased, the history of pages viewed and advertisements seen, search keywords entered by the User, dates and times of use, methods of use, usage environment, postal code, gender, occupation, age, the User's IP address, cookie information, location information, and device identification information.

Article 2 (Methods of Collecting Privacy Information)

  • The Company may, when a User registers to use the Service, ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver's license number. The Company may also collect transaction records containing the User's personal information that take place between the User and business partners, etc., and information related to payment, from the Company's partners (including information providers, advertisers, advertising distribution destinations, etc.; hereinafter, "partners").
  • The Company collects history information and characteristic information about Users—such as the services or software used, products purchased, the history of pages and advertisements viewed, search keywords entered, dates and times of use, methods of use, usage environment (including the communication status of the device when used via a mobile device and various configuration settings at the time of use), IP address, cookie information, location information, and device identification information—when Users use the services of the Company or its partners or browse pages.

Article 3 (Purposes of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows.

  • (1) To display registration information such as name, address, contact details, and payment method, information on the services used or products purchased, and the charges therefor, so that Users can view and correct their own registration information and view their usage status;
  • (2) To use email addresses to send Users notices and communications, and to use contact information such as name and address to send products to Users or contact them as necessary;
  • (3) To use information such as name, date of birth, address, telephone number, bank account number, credit card number, driver's license number, and the delivery results of certified mail in order to verify Users' identity;
  • (4) To use information related to payment, such as the names and quantities of products purchased, the type, period, and number of uses of services, billing amounts, name, address, bank account number, and credit card number, in order to bill Users;
  • (5) To display information registered with the Company on the input screen, or to transfer it to other services, etc. (including those provided by partners) at the User's instruction, so that Users can enter data conveniently;
  • (6) To use information for identifying individuals, such as usage patterns, name, and address, in order to refuse use by Users who have violated the Service's terms of use—such as by delaying payment or causing damage to third parties—or by Users attempting to use the Service for fraudulent or improper purposes;
  • (7) To use information necessary for the Company to provide services to Users, such as the content of inquiries and information related to billing, as well as Users' service usage status and contact information, in order to respond to inquiries from Users;
  • (8) Purposes incidental to the above purposes of use.

Article 4 (Provision of Personal Information to Third Parties)

  • Except in the following cases, the Company will not provide personal information to third parties without obtaining the User's prior consent. However, this excludes cases permitted under the Act on the Protection of Personal Information and other laws and regulations.
    • (1) Where based on laws and regulations;
    • (2) Where necessary for the protection of the life, body, or property of a person, and it is difficult to obtain the consent of the individual;
    • (3) Where particularly necessary for improving public health or promoting the sound upbringing of children, and it is difficult to obtain the consent of the individual;
    • (4) Where it is necessary to cooperate with a state organ, a local public entity, or a person entrusted thereby in performing affairs prescribed by laws and regulations, and obtaining the consent of the individual is likely to impede the performance of such affairs;
    • (5) Where the following matters have been notified or publicly announced in advance:
      • That provision to third parties is included in the purpose of use;
      • The items of data to be provided to third parties;
      • The means or method of provision to third parties;
      • That provision of personal information to third parties will be stopped at the request of the individual.
  • Notwithstanding the provisions of the preceding paragraph, the following cases shall not be deemed provision to a third party.
    • (1) Where the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use;
    • (2) Where personal information is provided in connection with the succession of business due to merger or other reasons;
    • (3) Where personal information is used jointly with a specific party, and that fact, together with the items of personal information used jointly, the scope of those using it jointly, the purpose of use by those using it, and the name of the person responsible for the management of such personal information, has been notified to the individual in advance or placed in a state where the individual can readily know it.

Article 5 (Disclosure of Personal Information)

  • When requested by an individual to disclose personal information, the Company will disclose it to the individual without delay. However, if disclosure falls under any of the following, the Company may not disclose all or part of it, and if it decides not to disclose, it will notify the individual to that effect without delay. Note that a handling fee of 1,000 yen per case will be charged for the disclosure of personal information.
    • (1) Where there is a risk of harming the life, body, property, or other rights and interests of the individual or a third party;
    • (2) Where there is a risk of significantly impeding the proper conduct of the Company's business;
    • (3) Where it would otherwise result in a violation of laws and regulations.
  • Notwithstanding the provisions of the preceding paragraph, information other than personal information, such as history information and characteristic information, will in principle not be disclosed.

Article 6 (Correction and Deletion of Personal Information)

  • Where the personal information held by the Company about a User is incorrect, the User may request the Company to correct or delete the personal information by the procedure prescribed by the Company.
  • Where the Company receives a request from a User as set forth in the preceding paragraph and determines that it is necessary to comply with the request, it will, without delay, correct or delete the relevant personal information and notify the User thereof.

Article 7 (Suspension of Use, etc. of Personal Information)

Where an individual requests the suspension or erasure of the use of personal information (hereinafter, "suspension of use, etc.") on the grounds that the personal information is being handled beyond the scope of the purpose of use, or that it was obtained by improper means, the Company will, without delay, conduct the necessary investigation, and based on the results, carry out the suspension of use, etc. of the personal information and notify the individual to that effect. However, where the suspension of use, etc. of personal information requires substantial costs, or where it is otherwise difficult to carry out the suspension of use, etc., and alternative measures necessary to protect the rights and interests of the individual can be taken, such alternative measures will be implemented.

Article 8 (Changes to the Privacy Policy)

  • The content of this Policy may be changed without notice to Users.
  • Except as otherwise provided by the Company, the revised privacy policy shall take effect from the time it is posted on this website.
